DESCRIPTION:This presentation will take place in the Concourse
Meeting Room. \n\nFor most public sector employers\, complying
with Florida’s Government in\nSunshine Law and Public Records Act
can be a huge headache. Even worse\,\nmany public sector
employers have been forced to defend themselves against\nlawsuits
brought under these laws. When litigation has occurred\,
many\npublic employers have been forced to pay substantial civil
penalties and\nawards of attorneys’ fees. In some instances\,
public officials have even\nbeen criminally prosecuted under
these laws.\n\nWhile criminal prosecutions are fortunately few
and far between\, it is not\nuncommon for public employers to
violate these laws. In many respects\,\naspects of both the
Government in the Sunshine Law and Public Records Act\nare
counter-intuitive\, and can be easily violated by those who
are\nunfamiliar with their requirements. \n\nIn this Breakfast
Briefing we will address the following questions\nregarding
Florida’s Government in the Sunshine Law:\n\n-Who is subject to
the Government in the Sunshine Law?\n\n-What constitutes a public
meeting for purposes of the Government in the\nSunshine
Law?\n\n-What kind of notice must be provided by law in order to
conduct a public\nmeeting?\n\n-Under what circumstances can
public boards or commissions meet outside of\nthe
sunshine?\n\n-Where must public meetings be held?\n\n-Issues
related to public access and voting.\n\n-Penalties for
noncompliance.\n\nAdditionally\, we will address the following
 questions concerning Florida’s\nPublic Records Act:\n\n-What
constitutes a Public Records Act Request under Florida
law?\n\n-What documents and records are deemed exempt from public
disclosure under\nthe Public Records Act?\n\n-How much time does
a public employer have to respond to a Public Records\nAct
 request?\n\n-Can an employer charge\, and require prepayment\,
for labor and copying\ncosts incurred in order to comply with the
 Public Records Act?\n\n-Penalties for noncompliance.
